Through our vast experience, we have seen firsthand the value of direct intervention by a highly qualified and experienced attorney. An uncooperative debtor might respond to a collection demand letter from an attorney in order to avoid a lawsuit.

In most instances, however, a letter from an attorney will not result in payment, a lawsuit will be filed.  This is because litigation is where a creditor can assert the most advantage and leverage over an uncooperative debtor who has not responded to earlier letters and phone calls.  Once we have filed a lawsuit and served the papers on the debtor, the clock begins to run on the debtor's earlier ability to delay payment simply by doing nothing. 

Once the debtor has received the lawsuit papers through a process server, the debtor might then be eager to work out a settlement rather than face a judgment followed by wage garnishment, repossession and other consequences of a debt collection lawsuit in the creditor's favor.
